Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets the rules for content and conduct on the FetchMy.art platform, including shop portals and catalogs hosted on fetchmy.art subdomains or connected custom domains (“Shop Sites”). It is incorporated into our Terms of Service and applies to every account holder, team member, and invited client. All content on the Service is uploaded by users; each Shop is responsible for everything uploaded to its workspace and displayed on its Shop Sites.
In plain English: Don’t upload anything illegal or that isn’t yours to use. Don’t attack the platform or other people. Adult artwork is allowed within the law — illegal content never is.
1. Illegal content and activity
You may not upload, store, display, publish, sell, or produce:
- Child sexual abuse material (CSAM) or any content that sexualizes minors, in any form, including illustrated, AI-generated, or stylized depictions. We report apparent CSAM to the National Center for Missing & Exploited Children and law enforcement, and terminate the account immediately.
- Content that is unlawful where you or your audience are located — including obscene material as defined by applicable law, non-consensual intimate imagery, true threats, incitement to violence, and content that violates court orders.
- Content that facilitates illegal activity, including counterfeit goods, controlled-substance sales, human trafficking, or fraud.
- Anything that violates export-control or sanctions laws, or that promotes terrorism or violent extremism.
2. Intellectual property and personal rights
- Do not upload designs, logos, characters, fonts, photographs, or other materials you do not own or hold sufficient rights to use — including rights adequate for how you use the Service (display, publishing, and physical reproduction through fulfillment).
- Do not use another person’s name, image, or likeness on products without the rights to do so (publicity and privacy rights).
- Do not remove or falsify copyright-management information, watermarks, or attribution.
- Copyright complaints are handled under our DMCA & Copyright Policy. Accounts that repeatedly infringe will be terminated.
3. Mature content
FetchMy.art serves working artists and shops, and we recognize that lawful artwork can include nudity, profanity, and other mature themes. Mature content is permitted on the platform subject to all of the following:
- It must be legal in the relevant jurisdictions — Section 1 always applies.
- Each Shop controls what appears on its own Shop Sites and is responsible for ensuring its public catalog is appropriate for its audience and complies with any age-verification or labeling requirements that apply to it.
- Mature content published to third-party channels must also comply with those channels’ own policies.
- Content flagged to us for review remains subject to removal if we determine in good faith that it violates this AUP or applicable law.
4. Platform integrity
You may not:
- Probe, scan, or breach security controls, or access or attempt to access another tenant’s workspace or data.
- Upload malware or malicious code, or use the Service to distribute it.
- Circumvent rate limits, plan limits, usage metering, or billing.
- Scrape the Service or Shop Sites at volume, harvest user data, or bulk-download content you do not have rights to.
- Reverse engineer the Service, resell or sublicense it, or use it to build a competing service.
- Interfere with the operation of the Service, including by imposing an unreasonable load on our infrastructure.
5. Abuse of others
- No harassment, hate directed at individuals or protected groups, stalking, or threats delivered through the Service (including through proofs, portal messages, or signature requests).
- No spam: do not send unsolicited proof requests, portal invitations, signature requests, or marketing through the Service to people who have no relationship with your shop.
- No impersonation of any person or organization, and no misrepresentation of your affiliation with anyone.
- No submitting knowingly false reports — including false DMCA notices — against other users.
6. Fulfillment orders
Orders placed through the fulfillment network must comply with this AUP and with production partners’ own content and product-safety rules. We may decline, cancel, or refund any order that we or a production partner reasonably believe violates this AUP, infringes third-party rights, or is unlawful to produce or ship to its destination.
7. Reporting violations
Anyone can report content or conduct that appears to violate this AUP by emailing abuse@fetchmy.art [TODO-LEGAL: confirm abuse@fetchmy.art mailbox exists and is monitored], or, for copyright complaints, by following the DMCA & Copyright Policy (which includes a takedown form). Include a link to the content and enough detail for us to evaluate the report.
8. Enforcement
We may investigate suspected violations and take any action we consider appropriate, including removing or disabling content, restricting features, suspending or terminating accounts and Shop Sites, cancelling fulfillment orders, and reporting to law enforcement where required or appropriate. Except where notice would impede an investigation, create legal exposure, or involve imminent harm, we will tell the affected Shop what action we took and why. We are not obligated to pre-screen content, and failure to enforce in one case does not waive our right to enforce in another.
